IRS Extends Filing Deadline to 10/15 for a Rebate

This article on BND.com discusses the IRS extending tax filing deadlines from April 15 to October 15. For those that currently collect Social Security Disability (SSDI and SSI Disability), this means if you have not filed already you may qualify still for a tax rebate.

"Don't worry if you did not file a return by April 15," IRS Commissioner Doug Shulman said in a statement. "If you meet the criteria, you are still eligible for a stimulus payment."

If you file your taxes by 10/15, the IRS can process payments until the end of this year.

NY seeks more Social Security Disability Help

I saw this article DemocratandChronicle.com. It appears the recent extension of Administrative Law Judges. For those in New York, in particular upstate New York this won't act as a dramatic relief to the existing lack of SS Administrative Law Judges.

SSI Application Denied

Was your SSI application denied? Did you know a SSI denied application occurs more often than not? It can be frustrating, but remember not to give up! There is an appeal process for SSI applications.

If you receive an SSI denial, remember that you have several options. First you can submit a Request for Reconsideration. If this is also denied (it is reviewed by the same people that originally denied your claim), you have an option to appear in front of an Administrative Law Judge at a Social Security Disability Hearing.

Remember, the earlier you get a Social Security lawyer involved, the faster the process can be affected. Below are some links and a website you can visit to receive a free case evaluation.

IRS Tax Rebate & SS Disability

How will IRS tax rebate check impact Social Security Disability recipients?

In May, 2008 the IRS will be sending out tax rebate checks. Many people are wondering if a $300 check will be deducted from their next month's Social Security payment. The answer is "no." One thing to remember, to get an IRS rebate check you have to file a tax return.

On 4/18 the Providence Journal ran a story about tax rebates and how it impacted SSI Disability. If you have a moment you should check out the reader feedback and Q&A.

Special Needs Trust & SSI

I saw this Elder Law article about Special Needs Trusts. There are some financial considerations you must consider when looking to create a Special Needs Trust. There are also a variety of factors that impact SSI and Medicaid.

For those that are not familiar with a Special Needs Trust:
Did you know that Federal law allows a disabled person's fund to be place in an irrevocable d(4) trust? A restriction is the disabled person must be under the age of 65. Also, the trust can be established by a parent, grandparent, legal guardian, or by a circuit court judge.

If you get a chance, check out the article.

I am disabled, is SSI, SSDI right for me?

If you're disabled, you may qualify for SSI or SSDI benefits. If you've had doubts about applying, you may want to reconsider. Every day you wait can result in a loss of benefits, that's because you are eligible for benefits from the day you become disabled. There is a cap on this of about one year, so saying you became disabled in 1975 won't help for 2008.

There are several ways you can apply for SSI and SSDI benefits. These methods include:

  • Walking into a Social Security Office and fill out a disability application
  • Calling Social Security from their toll free number: 1-800-772-1213
  • Applying online at ssa.gov
Will you need a Social Security lawyer for your application? Perhaps. That's for you to decide. If are are considering involving a lawyer you'll be refreshed to learn how the Social Security attorney fees work. Below is some more information about Social Security lawyers.

"Too often deserving disability benefit cases are denied because the applicant does not know how to document his disability and properly present it to the Social Security Administration."

The disability-focused PDF guide has also received search engine marketing efforts from Atlanta search engine optimization agency TwentySix2 Marketing. In efforts to maximize online marketing visibility and potential exposure to the disabled community TwentySix2 performed extensive keyword research to help ensure the SSD guide would rank well with search engine queries. The Atlanta web design agency also worked with Berry and Associates recently to launch an updated SEO-friendly website.

John Waddy, CEO of TwentySix2 Marketing said, "This disability guide has the potential to better educate the public about disability benefits and steps that they can take to document their claim when presenting it to Social Security. In particular, SSD (Social Security Disability), SSDI (Social Security Disability Insurance), SSI (Supplemental Security Income), DDS (Department of Determination Services), ODAR (Office of Adjudication and Review) and ALJ (Administrative Law Judge) are defined an explained from a Social Security Disability lawyer perspective.

The guide further examines the importance of medical evidence within a SSD claim and how disability medical impairments and symptoms play a critical role in presenting a SSDI and SSI Disability claim. The guide advises the disabled to work closely with their doctor to ensure disability impairments and symptoms are being documented as medical evidence.

Unique to this guide is the discussion around is a disabled claimant should seek the services of a Social Security Disability lawyer. IRS Tax Rebate & SSDI, SSI Disability

I came across this article on AmericanChronicle.com titled, "IRS Economic Stimulus Tax Rebate - How to Get Yours and Get it Fast!"

Below is a notable quote for those that receive SSDI:

It will be well worth filing for those who have at least $3,000 of income. While Social Security Insurance does not count towards income, Social Security Disability Insurance (SSDI) does. It is important to note that while SSDI is not taxable, it counts as nontaxable income to obtain a rebate and a return must be filed to claim the rebate.

Lack of Social Security Disability Judges

I saw this article about the lack of Social Security Disability judges:

There are 1,025 judges currently at work, and the wait for an appeals hearing averages more than 500 days, compared with 258 in 2000. Without new judges, federal officials predict even longer waits.

That statistic is going to prove frustrating for many people. You can assume as the baby boomers age the time to receive a Social Security Disability hearing is only going to grow longer.

RE: Disabled often wait years for Social Security payment

Check out the article Disabled often wait years for Social Security payment as it appeared in The Dallas Morning News on 4/6/08. Below is a sample of the text:

Patience and tenacity can pay off. About 60 percent of those who request hearings go on to win their cases.

Carolyn Watson filed for disability benefits after becoming clinically depressed and losing her job at a label manufacturer. The 58-year-old Terrell woman used up her $40,000 in savings, charged $25,000 on credit cards and borrowed from her mother while waiting almost two years for Social Security to rule.

"Luckily, I had already paid off my house and car," she said. "I don't know what I would have done otherwise."

Last year, Ms. Watson received $34,000 in retroactive benefits, including the $5,300 she paid Allsup, and began collecting $1,450 a month. She's started to pay off debts, and her disability status now qualifies her for Medicare. Without the coverage, her medications would cost $1,800 a month.

- The Dallas Morning News

The article helps illustrate why a Social Security Disability Lawyer could be helpful. In the coming years the baby boomers are going to make the Social Security Disability system work harder because of an influx of population that is aging.

People often ask, what happens at a Social Security Disability Hearing? For starters, compared to other court hearings, Social Security Disability hearings are less formal. There is alot at stake at there hearings--Social Security Disability benefits.

Here are a few words you'll often find associated with a SSD hearing: Administrative Law Judge, which is also called an "ALJ."

Prior to a hearing your SSD lawyer and the Administrative Law Judge (ALJ) will often hold a discussion about the nature of the case and procedural issues that will be addressed at the hearing.

The hearing will involve testimony of medical experts and your SSD lawyer may swear you in to testify.

Resources: Social Security Disability Hearing

If you still want to find information about SSD Hearings, I have authored an article titled "What is a Social Security Disability Hearing Like?" on several websites including:

I hope you enjoy the article. It's a great explanation of how an SSD hearing works and how a SSD lawyer can help you.
